RATIONALE FOR COMPLIANCE JUDGMENT |

Institutional polices are stated in the Faculty and Staff Handbook [1] and clearly reference TBR policies and guidelines. These guidelines are very clear on the legal authority and operating control of the institution. TBR guideline B-020 (Classification and Operation of Auxiliary Enterprises) governs auxiliary enterprises for all institutions in the system [2]. Policy defines an auxiliary enterprise as an enterprise that furnishes a service to students, faculty, or staff, and charges a fee directly related to, but not necessarily equal to, the cost of the service. The college is authorized to operate auxiliary enterprises which meet the definition of educational business activity as stated in guideline B-020. TBR guideline B-060 gives the college the authority to set fees pertaining to auxiliary enterprises [3]. TBR policy 04:02:10:00 establishes purchasing policy for auxiliary enterprises [5]. TBR guideline G-030 gives the college the authority to enter into contracts and agreements [4]. The college’s only auxiliary enterprise is the bookstore, which is contracted to College Bookstores of America. NSCC has no related or affiliated corporate entities except the foundation, which is addressed in 3.2.2.4. |
